Expert Terms and Conditions
These terms apply to your Lometa expert account, applications, Zoë screenings and interviews, and participation in expert opportunities. The scope, schedule, deliverables, and compensation for accepted project work are stated in the applicable opportunity or written project agreement.
Agreement and eligibility
These Terms are between you and Lometa LLC, a Texas limited liability company, with a notice address at 7710 N FM 620 Bldg 13-D, Austin, TX 78726, United States. By creating or using an expert account, you agree to these Terms and the Expert Privacy Notice. You must be at least 18 years old and legally able to enter into an agreement. If you accept work for an organization, you represent that you are authorized to do so and to bind it to the applicable project terms.
Account and platform access
Subject to these Terms, Lometa gives you a limited, personal, non-exclusive, non-transferable, and revocable right to access the expert platform for your profile, applications, interviews, and accepted project work. Keep your account and profile information accurate and current, protect your sign-in credentials, do not share or transfer your account, and promptly report suspected account compromise to privacy@lometa.si. Lometa may suspend or end access for violations, security risks, or as otherwise permitted by law.
Applications and opportunities
Opportunity listings describe potential work and do not guarantee selection, an engagement, or a minimum amount of work. You must complete applications and screening steps honestly and personally. Any accepted project is subject to its written scope, schedule, deliverables, rate or fee, payment terms, and other project-specific conditions. If these Terms conflict with a signed project agreement, the signed agreement controls for that project.
Acceptable use
Do not use the platform to violate law or another person’s rights; misrepresent your identity or qualifications; harass, threaten, or defraud others; send spam or malicious code; interfere with platform security or operation; access another user’s account or data; scrape or copy platform content without permission; or reverse engineer the platform except where applicable law does not permit that restriction.
Project and interview conduct
Submit work that is your own unless project instructions expressly allow assistance or other tools. Follow each opportunity’s instructions, confidentiality requirements, and security rules. Do not disclose or upload confidential information belonging to a current, former, or prospective employer or another third party without permission. Keep non-public interview questions, rubrics, prompts, answers, and materials confidential, and do not copy or distribute them unless Lometa authorizes it.
Zoë interviews and results
A Zoë screening or interview may collect your written answers and, where the format uses audio or video, a recording and transcript. The Expert Privacy Notice describes this processing. Where required, Lometa will obtain consent before recording. Authorized Lometa personnel may review responses and results to assess an application, maintain quality, and operate or improve screening services. Results may be shared with a client only as described in the applicable opportunity notice or project agreement. Zoë’s evaluation is a decision-support input and does not guarantee selection, employment, or an engagement; a Lometa employee makes the final decision in the documented workflow.
Interview materials and project work
As between you and Lometa, and to the extent permitted by law, Lometa owns the Zoë platform, interview questions and rubrics, platform-generated scores and evaluation results, and analyses derived from them. You assign to Lometa any rights you may have in interview-specific results and derived analyses, and grant Lometa the rights needed to use your interview responses to administer, review, secure, and improve the interview services, subject to the Expert Privacy Notice. This does not transfer ownership of your pre-existing materials or separate project deliverables; ownership and licenses for project work are set out in the applicable written project agreement.
Privacy
The Expert Privacy Notice explains how Lometa collects, uses, and discloses information in expert workflows and is incorporated into these Terms for privacy matters. Review it before creating a profile or participating in an interview. If the Privacy Notice and these Terms conflict on privacy processing, the Privacy Notice controls; a signed project agreement may add project-specific data-handling terms.
No promise of work; disclaimers
Lometa does not promise that an application, screening, or interview will result in selection, employment, an engagement, or any particular compensation. Except where these Terms or a signed project agreement expressly says otherwise, the platform and its materials are provided on an “as available” basis, without warranties to the maximum extent permitted by law. Nothing in these Terms waives rights that cannot legally be waived or determines worker classification contrary to applicable law.
Liability
To the maximum extent permitted by applicable law, Lometa and its affiliates, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, business interruption, or loss of data. To the maximum extent permitted by law, their aggregate liability arising out of or relating to these Terms or the expert platform will not exceed US$100. This limit does not apply where prohibited by law or to liability that cannot legally be limited.
Texas law and arbitration
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. Except that either party may ask a court for temporary injunctive relief to protect intellectual-property or confidential rights, disputes arising out of or relating to these Terms or the expert platform will be finally resolved by confidential, binding arbitration in English, administered by Judicial Arbitration and Mediation Services, Inc. (JAMS) under its Streamlined Arbitration Rules and Procedures then in effect. The arbitration will take place in Austin, Texas, unless the parties agree otherwise. The arbitrator may award relief available under applicable law. Nothing in this section limits rights that cannot legally be waived.
Changes and other terms
Lometa may update these Terms by posting a revised version and, where required, notifying you through the platform or another appropriate channel. If a provision is unenforceable, it will be limited only as much as needed and the remaining provisions will continue to apply. Failure to enforce a provision is not a waiver. These Terms and applicable project agreements describe the agreement concerning their respective subjects and supersede prior discussions on those subjects. Questions or notices may be sent to privacy@lometa.si or mailed to Lometa LLC, 7710 N FM 620 Bldg 13-D, Austin, TX 78726, United States.
